No. Insolvency restructures debts into a payment agreement with viable terms and instalments, and suspends collection proceedings while negotiating. It is an orderly restructuring, not forgiveness. Be wary of anyone offering to erase debts: that does not exist under Colombian law.

The law sets a 60-day negotiation period, extendable by 30 days. In practice, three to five months usually elapse between filing and agreement, depending on the number of creditors and their willingness to negotiate.

Insolvency aims to protect your assets, not liquidate them. Your home can be included in the agreement and kept if the payment plan is viable. Only where no agreement is reached can the process lead to asset liquidation. That is precisely the difference good representation at the hearing makes.

The report stays in place during the process, but once the payment agreement is performed the record can be updated. We manage that update with the source and the bureau as part of post-agreement support.
